GENERAL TERMS AND CONDITIONS OF THE SUPERNOVA GIFT CARD IN SLOVENIA

 

General Terms and Conditions
Article 1

The General Terms and Conditions of Business with the Supernova Gift Card (hereinafter referred to as the “General Terms and Conditions of Business”) form the legal basis for business transactions with the Supernova Gift Card. The General Terms and Conditions bind both the Issuer and the Holder of the Supernova Gift Card. By purchasing or using it, each Supernova Gift Card Holder undertakes to know and comply with the respective valid General Terms and Conditions.

 
Issuance, purchase and use of the Supernova Gift Card
 
Article 2

The Issuer of the Supernova Gift Card (hereinafter referred to as the “ Supernova Gift Card") in Slovenia is the company Supernova Marketing d.o.o., Jurčkova cesta 223, 1000 Ljubljana (hereinafter referred to as the “Issuer”).

The SN gift card is valueless until it is topped up with a certain credit at the time of purchase. The Slovenian SN Gift Card is available EUR (€). The SN Gift Card can be bought at specific Supernova centers in Slovenia or via www.supernova-kartica.si.

SN Gift Card bought in Slovenia or via www.supernova-kartica.si, can only be used in Supernova shopping centers in Slovenia. The list of shopping centers, in which the gift card can be redeemed can be found at www.supernova-kartica.si.
 

It can be used several times until the credit is used up (in the event that the value of the purchase is lower than the value of the credit on the Gift Card, the remaining value will be noted on the Gift Card and can be used for the next purchase until the credit used up).

 
Article 3

Supernova Gift Card is a credit card with a barcode, which can be used to pay for goods and services in accordance with the General Terms and Conditions. Each Supernova Gift Card has a unique identification number.

The Supernova gift card is not a name card, and it is not necessary to provide personal information when purchasing. In the case of online orders, the personal data provided (necessary for the processing of the purchase) is collected and stored in accordance with the Data Protection Act and is used only for this purpose (the purpose of processing the purchase).

The SupernovaGift Card is a bar-coded means of payment in plastic or electronic form (pdf document). The Supernova gift card is not a loyalty card and is not a name card (caution in case of loss).

 
Article 4

It is possible to purchase an Supernova Gift Card both offline and online.

You can buy the Supernova Gift Card offline during the shopping centre opening hours at the respective points of sale (info Point or gift card kiosk):

  • Info point Supernova: Supernova Ljubljana Rudnik, Supernova Ljubljana Šiška
  • Kiosk (gift machine): Supernova Mercator Nova Gorica
  • Info point of the Spar/Interspar store: Supernova Kranj, Supernova Nova Gorica, Supernova Novo mesto, Supernova Kamnik, Supernova Maribor and Supernova Ptuj
  • Info point of the Mercator store: Supernova Mercator Novo mesto, Supernova Mercator Primskovo, Supernova Mercator Savski otok, Supernova Mercator Koper, Supernova Mercator Jesenice, Supernova Mercator Celje, Supernova Mercator Sloven Gradec. 

Please note that access to points of sale may vary depending on the opening hours of the shopping centres concerned.

Online purchase of the Supernova Gift Card is possible via the link: www.supernova-kartica.si.

 
Article 5

The minimum amount that can be added to the SN Gift Card is €10 (in words: ten euros), the maximum amount that can be added to the Gift Card is € 300 (in words: three hundred euros). 

The SN Gift Card is topped up with credit when you make a purchase at the point of sale or via the online shop. 

The purchase with a SN Gift Card is possible up to the amount of available amount on the gift card. If the amount on the gift card is not enough to complete the entire purchase, the customer pays the difference up to the value of the purchase of the goods. If the purchase value is less than the available amount on the gift card, the remaining value can be used until the gift card expires.

You can use the SN Gift Card until it is empty during its validity period (the balance is zero euros). The SN Gift Card cannot be recharged. The balance on the SN Gift Card is not subject to interest. It is not possible to buy in instalments with a gift card. Gift cards cannot be exchanged for cash.

The SN Gift Card Holder can check the balance on SN Gift Card and the validity date at points of sale, in the online shop (www.supernova-kartica.si) and when shopping in stores/shops with established SN Gift Card systems.

 
Article 6

For ordered Supernova Gift Cards, the customer (natural person, legal entity) will be issued an proforma invoice and invoice consisting of two parts:

  • 1st part: value of ordered Supernova Gift Cards (number of Gift Cards x credit in balance in €/card), with no VAT charges (0%).
  • 2nd part: costs for processing and shipping Supernova Gift Cards and possible personalization costs. The cost of shipping Supernova Gift Cards is zero in case of personal withdrawal (collection) of the ordered Supernova Gift Cards.
Shipping is possible only in Slovenia. 
Purchase of a Supernova Gift Card for legal entities
 
Article 7

Physical Supernova Gift Cards can be purchased at the info point in Supernova Ljubljana Rudnik. The legal entity can pay at the above-mentioned info points with cash or a payment card (POS terminal). You will receive physical Supernova Gift Cards on the spot.

A legal entity may place orders for physical or Supernova e-Gift Cards via the website www.supernova-kartica.si. After filling in the form on the website, the legal entity will receive a proforma invoice (to the e-mail address indicated in the form). When the proforma invoice for the order is paid (the funds are seen in the bank account of Supernova marketing d.o.o.), the Supernova Gift Cards are issued. The Supernova e-Gift Cards are sent to the e-mail address provided by the legal entity in the form, physical cards are sent by mail or prepared for personal collection at the info point in Supernova Ljubljana Rudnik (Jurčkova cesta 223, 1000 Ljubljana). If the legal entity wishes to receive the cards Supernova Gift Card by post, it must indicate the postal address in Slovenia (for delivery) when ordering and, in this case, it must cover the delivery costs. The Issuer is not liable for any damage or loss in the event of dispatch.

Shipping is only possible to an address in Slovenia.

If the legal person is a budgetary authority, please contact the info point Supernova Ljubljana Rudnik (info@supernova.si) to obtain the Supernova Gift Card.

If the Issuer does not receive the money transfer within 7 working days ofrom the order, the order is considered cancelled. If the customer wishes to cancel his order or, after receiving the Supernova Gift Card, wishes to return the ordered goods, he must report this in writing to info@supernova.si within 1 year from the date of purchese (with the vaule on the cards intact). In this case, the Issuer will return the amount equal to the value of the ordered Supernova Gift Cards, but will retain the costs of processing and shipping, as well as the cost of personalisation.

It is not possible to purchase the Supernova Gift Card in instalments.

 
Redeeming the Supernova Gift Card
 
Article 8

The SN Gift Card can be used the below shopping centres in Slovenia:

  • Supernova Nova Gorica
  • Supernova Novo mesto
  • Supernova Kamnik
  • Supernova Maribor

  • Supernova Mercator Nova Gorica
  • Supernova Mercator Novo mesto 
  • Supernova Mercator Primskovo
  • Supernova Mercator Savski otok
  • Supernova Mercator Ajdovščina
  • Supernova Mercator Postojna
  • Supernova Mercator Celje
  • Supernova Mercator Koper
  • Supernova Mercator Slovenj Gradec

The Gift Card can be used in all branches/stores with an established system for redemption of the SN Gift Card within the relevant centre. The number of locations or shopping centres can be changed. 

The SN Gift Card can be used according to its purpose. The SN Gift Card is available in several different printed thematic motifs or by the online Gift Card buyer own design. 
 

Article 9

Purchases with a Gift Card can only be made in the amount of the credit on the Gift Card. If the value of the credit balance on the Gift Card is not sufficient to cover the entire purchase, the customer pays the difference to the value of the purchased goods. If the value of the purchase is lower than the value of the credit on the Gift Card, the remaining value is recorded on the Gift Card and can be used until the expiration of the Gift Card. It is not possible to make a purchase with the SN Gift Card in instalments. The Gift Card cannot be exchanged for for cash and it is not possible to pay out the balance that is left in the gift card in cash. The Gift Card is linked to the internal system of the participating Supernova shopping centres. If this system does not work and it is therefore not possible to check and deduct the amount of money on the Gift Card, purchase with the Gift Card is not possible until the Gift Card system is restored.

 
Validity, use and termination of the right to use the Supernova Gift Card
 
Article 10

SN Gift Card isn Slovenia is valid for 4 (four) years from the date of charging; however, SN Gift Cards purchased before 1 April 2019, are only valid for 2 (two) years. After the expiration date Supernova Gift Card, no credit is available and expires; consequently, the Holder of the Supernova Gift Card is no longer entitled to the credit. The buyer or the Holder of the Supernova Gift Card is obliged to keep a record of maturity, as he does not receive any prior notification of the due date of the Supernova Gift Card.

For further information about the due date of the Supernova Gift Card, the Holder should contact the Info Point at Supernova Ljubljana Rudnik (info@supernova.si).

 
Article 11

The SN Gift Card is not issued in the name and surname of the buyer and/or holder. The Holder of the Supernova Gift Card can transfer the Supernova Gift Card to a third party without restriction. By transferring the rights of the Supernova Gift Card, the new Holder acquires all the rights that the previous Holder had. The Issuer of the Gift Card is not obliged to verify the identity of the person and is not responsible for any loss, damage or misuse of the Supernova Gift Card.

 
Loss and theft of the Supernova Gift Card
 
Article 12

The Issuer of the Supernova Gift Card is not responsible for the loss or theft of a Supernova Gift Card and all possible damage caused by improper disposal of the Supernova Gift Card and unjustified use of credit on the Supernova Gift Card.

If the Supernova Gift Card, which is not due to improper handling, the Supernova Gift Card Holder can bring the Supernova Gift Card to the Info Point of the shopping centre Supernova Ljubljana Rudnik or Supernova Ljubljana Šiška.

 
Redeeming of the Supernova gift vouchers
 
Article 13

The redemption of a Supernova paper voucher that is not registered in the card system can still be done. The holder of the the Supernova paper voucher can uses it for services and products in Supernova Ljubljana Rudnik.

 
Replacing your Qlandia Gift Card for the Supernova Gift Card
 
Article 14

In 2020 the former Qlandia shopping centers (Kamnik, Novo mesto, Nova Gorica, Maribor, Ptuj and Kranj) became part of the Supernova shopping centre group. Sales of Qlandia Gift Cards in these shopping centres and via the website www.qlandia-kartica.si are discontinued. The Qlandia Gift Card is replaced by the Supernova Gift Card.

The Qlandia Gift Card Holder can swap their gift card for a Supernova Gift Card. The replaced, newly issued Supernova Gift Card or e-Gift Card takes on all the features and characteristics of the Supernova Gift Cards.

The Holder can swap the Qlandia physical or e-Gift Card for the Supernova e-Gift Card free of charge on the website www.supernova-kartica.si. The new Supernova e-Gift Card is valid for 4 years from the date of replacement. The newly issued Supernova e-Gift Card one is redeemable from the day of swapping in all Supernova Qlandia shopping centres (listed above) and other selected Supernova shopping centres in Slovenia.  

As of 2022, Qlandia Krško is no longer part of the Supernova chain of shopping centers. Since then, redemption (and purchase) of the SN Gift Card is no longer possible there.

 

Exchanging your Qlandia gift vouchers for the Supernova Gift Card
 
Article 15

Qlandia gift vouchers can be exchanged for physical Supernova Gift Cards vouchers with a bar code free of charge at the Info Point of Spar stores and Interspar megamarkets in all former Supernova Qlandia shopping centres throughout Slovenia (now Supernova: Kamnik, Novo mesto, Nova Gorica, Maribor, Ptuj and Kranj). In this exchange, the monetary value of Qlandia paper gift vouchers is retained and transferred to the Supernova Gift Cards. The new Supernova Gift Card is valid for 4 years from the date of replacement.

When exchanging one or more Qlandia gift vouchers for one Supernova Gift Card, the buyer will receive 1x Supernova Gift Card, unless the buyer wants to exchange more than 30 Gift Vouchers worth 10 EUR, which exceeds the maximum value of the Supernova Gift Card. In this case he/she will receive the next lowest possible number of Supernova Gift Cards. In this case, he/she will receive the next lowest possible number of Supernova Gift Cards. 

At the info point in former Supernova Qlandia shopping centres, now Supernova, it is possible to exchange gift vouchers that are recorded in the card system (check at the Info Point). If the gift voucher is not entered in the card system, the centre manager exchanges the gift certificate (filling out the application). 

Gift vouchers that the buyer wishes to exchange for one Supernova Gift Card, must be blank and undamaged (doodled on or damaged gift vouchers cannot be exchanged for the Supernova Gift Card). When exchanging gift vouchers for a Supernova Gift Card, you will receive one (1) copy of the Supernova Gift Card exchange (purchase) certificate. Keep this certificate for possible complaints about the Supernova Gift Card (complaints about the sold Qlandia Gift Card can be made within one (1) month after purchase) at the Info Point of Spar stores and Interspar megamarkets in former Supernova Qlandia shopping centres, now Supernova.


Supernova Gift Card Personalization Rules
 
Article 16

The Supernova physical gift card and e-gift card can be personalized with your own photo via the web interface on the website www.supernova-kartica.si. The personalization service is provided by the Issuer in accordance with the brand graphical identity of the SN Gift Card. 

In the case of a physical and SN e-Gift Card, the buyer has the possibility to upload his personal design for the front of the Gift Card (the back of the gift card cannot be changed) or the top of the e-gift card (pdf, the bottom of the document cannot be changed), taking into account the technical requirements of the submitted materials and the rules for the selection of the motif, which are described in this document and on the website www.supernova-kartica.si

(The recipient can save the PDF document on their phone or print it out. In order to redeem a Supernova e-gift card, it is mandatory that the barcode is clearly visible.)

The buyer guarantees that he is the owner of the design used on the SN Gift Card or that he has obtained the express consent of the owner and/or the person depicted on the design to use his design on the SN Gift Card, and that the Issuer does not infringe any personal or other rights of third parties, including intellectual property rights. 

The chosen motif personalize the gift card via the website www.supernova-kartica.si must meet the following technical requirements:

  • Format: jpg, jpeg or png.
  • Maximum file size allowed: 20 MB.
  • Minimum file size: 1011 x 638 (638 x 1011), 300 dpi.
  • The file must be smaller than 3344 x 5017 pixels.

There may be a colour or other design difference between the selected motif on the computer screen and the finished SN Gift Card motif that does not constitute a justified reason for complaint.

The selected theme must not contain (or refer to):

  • Photographs, pictures, graphics or other material of famous or public figures, musicians, politicians, actors, athletes and cartoon or computer characters.
  • Photographs, pictures or other material that is copyrighted by someone else.
  • Profanity, defamation or content that violates any rules or laws to which they are subject.
  • Bar codes.
  • Content and elements that could in any way compromise the security elements on SN Gift Card or could have the effect of her abuse.
  • Slogans, artwork, trademarked material.
  • Offensive and provocative images, graphics or other material with religious, racist, hateful, violent or political messages in all forms.
  • Offensive motifs or motifs with sexual content.
  • Nudity or partial nudity.
  • Photographs depicting tobacco, drugs, gambling, firearms or pharmaceuticals.
  • Photographs, pictures or graphics of state or national symbols, currency or money.
  • Telephone numbers, addresses, web addresses, account numbers or personal numbers.
  • Violent or other offensive, racist, hateful, degrading or obscene content and photos, images or other.
  • Materials of socially unacceptable groups.
  • Religious content and images that depict the opinions or beliefs of political, religious groups.
  • Images depicting illegal or anti-social behaviour and culturally or socially sensitive topics.
  • Motifs, symbols or logos of the Olympic Games or other sports competitions or events.

The Issuer has the right to reject a motif without specific justification if it believes that it is not suitable for use on a physical or electronic SN Gift Card and that it may damage Supernova's reputation. 

The Issuer reserves the right to change or supplement the rules and instructions for creating a SN Gift Card at its own discretion and without giving a reason. Each personalized physical and e-Gift card ordered by a natural or legal person is reviewed and approved by the Issuer before being issued (to ensure content suitability).

The buyer confirms that he/she has read and understood the rules for the selection of the design on the Gift Card and declares that he/she will only submit designs with his/her own design that comply with the rules specified in this document and on the website www.supernova-kartica.si.

The Issuer will inform the costumer of the SN Gift Card about the possible rejection of the ordered motif for personalization of the SN Gift Card by e-mail, specified by the customer in the order request. After confirmation of the placed order and payment of the ordered SN Gift Cards, no complaint on the basis of appearance of the SN Gift Cards is accepted. 


Loss, damage of the Supernova Gift Card
 
Article 17

In the event of a lost SN Gift Card, the Holder is not entitled to a replacement. Lost SN Gift Cards are kept for 1 month after they are found at the Supernova Ljubljana Rudnik and Supernova Ljubljana Šiška Info Points, and at the info points of stores Spar, Interspar megamarkets or Mercator. The lost/found SN Gift Card item will be handed over to the Holder when the latter presents a proof of purchase of the SN Gift Card in question.  

In the case of a damaged SN Gift Card’s bar code, the owner can still make a purchase, but the bar code must be legible so that the seller can manually enter it into the card system. The Issuer of the SN Gift Card is not responsible for the loss or theft of a SN Gift Card and all possible damage caused by improper disposal of the SN Gift Card and unjustified use of credit on the SN Gift Card.

 
Resolving complaints when purchasing the Supernova Gift Card
 
Article 18

The Issuer is responsible for resolving complaints regarding purchase of the SN Gift Card. 

In case of errors that occurred when buying the SN Gift Card, the customer will solve the complaint promptly at the Info Point where the customer bought the SN Gift Card and loaded the desired credit on it.

In the event of later complaints, the buyer of the SN Gift Card should contact the Info Point in Supernova Ljubljana Rudnik shopping centre (info@supernova.si). Complaints are possible 1 month after the purchase of the SN Gift Card (period begins from the date of purchase, stated on the purchase confirmation). The signed purchase receipt is the basis for any SN Gift Card complaint. No complaint is possible without a purchase confirmation. 

 
Resolving complaints when redeeming the Supernova Gift Card
 
Article 19

In case of errors and ambiguities related to the redemption of the Supernova Gift Card, the customer solves the complaint at the point of sale (in the store), where they make the purchase with the SN Gift Card.


Protection of personal data
 
Article 20

The Issuer is aware of the importance of the protection of personal data and for this purpose handles personal data in accordance with the law and collects, processes and stores personal data only for the purpose of processing the purchase of the SN Gift Card. It treats personal data in strict confidence, within the framework of confidential processes and a strict company policy regarding the protection of personal and business data and in accordance with the Personal Data Protection Act (ZVOP-2) (Official Gazette of the Republic of Slovenia, No. 163/22), Electronic Communications Act (ZEKom-2) (Official Gazette of the Republic of Slovenia, 130/22 and 18/23 – ZDU-1O) and the General Regulation on Data Protection(GDPR ). It grants access to the data only to employees and external contract partners who have committed themselves to corresponding confidentiality obligations. Under no circumstances will the organizer pass on or disclose the personal data received to third parties.

The personal data obtained will be used only for the purpose of purchasing the SN Gift Card. In the case of a purchase as a natural person, these are the data of the buyer as a costumer and data of the recipient of the SN Gift Card for which the buyer wishes to make a purchase. These data include: first name, last name, street and house number, postal code, city, country, e-mail address and telephone number, and credit card information. In case of a purchase as a legal entity, the following information: In case of a purchase as a legal entity, the following information: company name, street and house number, postal code, city, VAT ID, contact person for the order, e-mail address, bank account and information on whether the company is a budgetary authority. All this data is transmitted over a secure SSL protocol. This SSL protocol allows personal data to be encrypted and to travel securely over Internet connections. Encryption is activated before the start of the transfer of personal data. In addition, the data behind the so-called "firewalls" is protected from any external access.

According to the GDPR, the person responsible for processing personal data may process personal data if the personal consent of the individual is given, i.e. a voluntary declaration that his/her personal data may be processed for a specific purpose. The user confirms it as part of the Supernova Gift Card order by clicking the button: ORDER.

All data will be stored in the database of the company of the Issuer and/or at the contract processors of personal data in accordance with the legal time limit or until the participant revokes the storage of personal data.

 
Final and transitional provisions
 
Article 21

These General Terms and Conditions or any changes to the General Terms and Conditions shall take effect on the day they are posted on www.supernova-kartica.si. Upon the effective date of these Terms and Conditions, all previous versions shall cease to be valid.

The Issuer reserves the right to change these Terms and Conditions at any time without prior notice, including specifying vendors or shops where the use of the SN Gift Card is or is not possible. 
 


Article 22

Unauthorized and illegal use of the SN Gift Card is a criminal offense. The Issuer may refuse the use of the SN Gift Card if it determines that the product is a counterfeit, if its validity has expired or if it is Supernova Gift Card so destroyed or damaged that it is impossible to deduce the amount and read the credit from it. Any disputes between the Holder and the Issuer of the Supernova Gift Card shall be settled before the competent court in Ljubljana, Slovenia, unless another court has exclusive jurisdiction over an individual dispute.
